Welcome to I am Ballito. By using this website, engaging with our social media pages, submitting information to us, advertising with us, redeeming a voucher, entering a competition, or taking part in any I am Ballito feature or promotion, you agree to these Terms and Conditions.

I am Ballito is a local lifestyle, community, media and advertising platform based in Ballito, KwaZulu-Natal. We share local business features, events, promotions, voucher offers, radio content, community information and lifestyle content.

1. Using I Am Ballito

You agree to use I am Ballito lawfully and respectfully. You may not share false, misleading, unlawful, abusive, threatening, defamatory, racist, sexist, homophobic, hateful or discriminatory content. You may not copy, steal or misuse our content, branding, designs or platform; upload viruses, spam or harmful content; pretend to be someone else; or misrepresent a business.

We may remove, refuse, block or take action against content, accounts, submissions, promotions or behaviour that breaches these Terms or could harm our community, partners, advertisers or platform.

2. Accuracy of Information

We do our best to keep information useful and current, but local business details can change. Opening hours, prices, menus, event details, voucher availability and contact information should be confirmed directly with the relevant business or organiser. We are not responsible for third-party changes, errors, cancellations or outdated information.

3. Businesses, Events and Third Parties

Businesses, venues, advertisers, event organisers and service providers featured on I am Ballito are independent third parties. Any agreement, purchase, booking, redemption or interaction between you and a third party is between you and that third party. We are not responsible for third-party products, services, pricing, refunds, safety, cancellations, customer service or external websites.

4. Advertising and Sponsored Content

We offer advertising and promotional opportunities. Advertisers are responsible for ensuring that information they provide is accurate, lawful and not misleading. We may refuse, edit, delay or remove advertising or sponsored content at our discretion. We do not guarantee sales, leads, bookings, followers, redemptions, attendance or other results from advertising.

5. Payments, Cancellations and Refunds

Payment terms for advertising, media, design, campaign, printing or promotional services will be set out in the relevant quote, invoice, package, proposal or written agreement. Some services may need to be paid in advance.

If a booking, campaign or service is cancelled after work has started, we may charge for work already completed, time spent, reserved advertising space, design work, printing, administration and third-party costs. Refunds or credits are discretionary unless otherwise agreed in writing.

6. Vouchers and Promotions

We may publish printed or digital vouchers, discounts, offers or promotions with participating businesses. Each offer may have its own terms, expiry date, booking requirements, exclusions, availability limits or minimum spend. The participating business is responsible for honouring its offer according to those terms.

Vouchers are not cash and cannot be exchanged for cash unless expressly stated. We are not responsible if a voucher cannot be redeemed because it expired, the user did not follow the terms, the business is closed, the offer changed, or a reason outside our control applies. Please contact the business first; we may assist where reasonable.

7. Competitions and Giveaways

Competitions and giveaways may have their own rules. Prizes are not transferable, exchangeable or redeemable for cash unless stated. We may disqualify entries that are incomplete, fraudulent, abusive, automated, duplicated or in breach of the applicable rules.

8. Content Submitted to Us

If you submit photos, videos, messages, reviews, business information, event details, voice notes, interviews, testimonials or competition entries, you confirm that you have the right to share that content, that it is accurate to the best of your knowledge, and that it does not infringe anyone else's rights or contain unlawful, abusive, defamatory, misleading or discriminatory material.

By submitting content, you give us permission to use, edit, publish and share it across our website, social media, radio, print, newsletters and other platforms for editorial, promotional, advertising and community purposes. Content involving children must only be submitted with parent or guardian consent.

9. Photos, Videos and Media

If you take part in an interview, event, feature, recording, photo, video or promotion connected to I am Ballito, you agree that we may use that material for publication, promotion and marketing, including on our website, social media, radio, print, newsletters, reels, stories, videos and advertisements.

10. Intellectual Property

We own or have permission to use the branding, website content, designs, graphics, articles, photos, videos, audio, radio content, voucher layouts, advertising concepts and promotional material on I am Ballito. You may not copy, reproduce, edit, sell, republish or use our content without written permission.

You may share our social media posts using normal platform sharing tools, provided you do not alter them or present them as your own. Advertisers keep ownership of their own logos, images and brand material, but grant us permission to use them for the agreed feature, listing, advert or campaign.

11. Privacy

We may collect and process personal information when you contact us, advertise with us, submit content, enter competitions, subscribe, attend events or communicate with us. We handle personal information in line with South African privacy laws and our Privacy Policy. The Privacy Policy explains what we collect, how we use it, how long we keep it and how we protect it.

12. External Platforms

We may operate on external platforms such as Facebook, Instagram, WhatsApp, TikTok, YouTube, Google, radio or streaming platforms. Those platforms have their own terms and policies. We are not responsible for outages, restrictions, account issues, algorithm changes, removals or policy decisions made by external platforms.

13. Limitation of Liability

To the fullest extent allowed by law, I am Ballito is not liable for losses, damages, claims, costs or inconvenience arising from use of our platform, reliance on information, third-party businesses, products, services, events, voucher issues, advertising performance, technical problems, user-submitted content, external websites or external platforms. Nothing in these Terms excludes liability where the law does not allow it.

14. Changes to These Terms

We may update these Terms from time to time. The latest published version will apply from its updated date. Continued use of I am Ballito means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
